I requested John Dixon to send the section and Act under which he requested odometer readings.

Mr Dixon replied with a copy of section 81 of the Social Security Act 1964


Thank you for your letter dated 17 March 2008 requesting that we provide written verification of the clause/s to which you say specifically gives Work and Income the ability to request odometer readings.


The issues of your Disability Allowance and increase in kilometer allowable rate (petrol costs) have been forwarded to the Regional Solicitor for consideration. -The Solicitor advises as follows:


Under section 81 of the Social Security Act 1964 the Chief Executive can request the client or partner to provide any information or to answer any relevant question orally or in writing,

and in a manner specified by the Chief Executive. The case managers of Work and Income have the delegated authority of the Chief Executive to request such information. Section 81 states:


8l Review of benefits

(1)The chief executive may from time to time review any benefit in order to ascertain—
(a) whether the beneficiary remains entitled to receive it; or
(b)whether the beneficiary may not be, or may not have been, entitled to receive that benefit or
the rate of benefit that is or was payable to the beneficiary—
and for that purpose may require the beneficiary or his or her spouse or partner to provide any
information or to answer any relevant question orally or in writing, and in the manner specified
by the chief executive. If the beneficiary or his or her spouse or partner fails to comply with
such a requirement within such reasonable period as the chief executive specifies, the chief
executive may suspend, terminate, or vary the rate of benefit from such date as the chief
executive determines.

(2)If after reviewing a benefit under subsection (1), the chief executive is satisfied that the beneficiary is
no longer or was not entitled to receive the benefit or is or was entitled to receive the benefit at a
different rate, the chief executive may vary the rate of the benefit from such date
as the chief executive reasonably determines.

(3)If after reviewing a benefit under subsection (1), the chief executive considers the beneficiary is
more appropriately entitled to receive some other benefit, the chief executive may, in his or her
discretion, cancel the benefit the beneficiary was receiving and grant that other benefit commencing
from the date of cancellation.


The Regional Solicitor confirms that the odometer reading is required and is a viable request in order to review ongoing entitlement to the travel related cost component of your and your wife’s disability allowance.


The Solicitor is also seeking confirmation from you as to which car you use for you travelling. In your letter to the Chief Executive dated 16 January 2008 you stated that “at that time we had the 1800cc Corona.” However, in your letter dated 24 January 2008 to the Chief Executive you state “We owned - and still do - a 1800 cc 1991 Toyota Corona at the time the 78cents was allowed and is still used for most of our transport as it is a cheaper to run.”


Can you please confirm which car is used for travel. If both cars are used can you please provide odometer readings for both vehicles.


We look forward to receiving the requested information.



I immediately complied with the request. The readings more than covered the number of allowable weekly kilometers.


WINZ letter dated 16 April 2008

The application for an increase to $1.10 a kilometer was denied “until such time as current policy rates for travel are reviewed”. (Ten years, twenty years, never?)


The alternative request that Sheryl's special benefit be calculated outside the Minister's formula was also denied as there are no special and unusual circumstances”.

A letter received from our case manager states: We have reviewed your Special Benefit, your payment will continue at the same rate”


This brings me to the reason for denying Temporary Additional Support and Special Benefit because there are no “special and unusual circumstances”. See: WINZ - Poor crushed
