Tricky Stuff _ Remember Bea? She was the experienced staff member of the WINZ Foxton Work and Income office. (Some time ago Bea approached me in the New World Supermarket and whispered “Arsehole”). Anyway, an invalid came to me inquiring about Bea refusing to review his Temporary Additional Support. (T.A.S.) She had asked him if he was “happy with that”, (Having his TAS cancelled). “Not at all”. he replied “providing you give me verification of your refusal in writing”. |

Discretion
The Department of Work and Income inappropriately applies “discretion” to negate an client's application for assistance. Many have stated it should be prosecuted for benefit fraud.
Although it is supposed to assist those in financial need, in reality its true purpose is to mislead applicants in order to deprive sick and disabled New Zealanders the financial support legislation provides.
Assessment
The Minister's Directive to Work and Income says that WINZ has to work out the weekly income of an applicant then subtract rent and other approved essential expenses. If what is left is not enough to cover minimum living costs (called Standard Costs) the Department should regard as justified the fixing of a T.A.S. or Special Benefit to make up the shortfall. Very straight forward. No discretion here.
However, in reality, deception, or tricky-dickey stuff is often applied to deny assistance rather than applying the law to fund the shortfall through T.A.S.
The sole justification for declining Temporary Additional Support is that the circumstances were not considered “special or unusual.”
WINZ management has stated that the Social Security Appeal Authority has never said that this reason for declining was wrong. This is not correct. In 1996 it ruled that the Department “Did not conform to the Ministerial Direction”.
WINZ staff are encouraged not to grant Temporary Additional Support, but to give out loans instead. Thus creating more, unnecessary debt for the applicant.
Advocacy groups and other prominent citizens have long claimed that there are well over 160,000 New Zealanders being cheated out of their entitlements. As consequence they remain impoverished, hungry, and miserable.
Special Benefit or T.A.S. calculation
Take a 42 year old invalid beneficiary. WINZ says that a 45 year old invalid should be able to purchase food, clothing, power, run and maintain a vehicle, pay rent, and purchase those those items and services needed to run a household. All this on $223.10 a week. Let's set out the assessment and calculation for T.A.S.

Total Income of 304.22 less total weekly costs of 218.12
= Disposable income of $ 86.10
Less Standard Costs of $156.17 (“Standard Costs” are the minimum weekly amount the Department says is required for essential food, clothing, toiletries, power, etc.
is (a) $70.10 This is called the “DECICIENCY - Greater amount”)
30% of total costs of $218.12 is (b) $ 65.43 This is called the “DEFICIENCY - Lesser amount” Special Benefit or Temporary Additional Support is the lesser of the two amounts.
Therefore his income of $ 304.22 plus T.A.S. or Special Benefit of $65.50 (rounded up)
= $327.98
Total Weekly Benefit for this particular invalid beneficiary should be $327.98
(I have phoned WINZ Call Centre on at least three occasions and requested the “Standard Cost” figure. Each time I was told they did not know what I was talking about. The figure is needed to arrive at the exact amount of Temporary Additional Support to which the invalid in question is entitled. I have written to the CEO of Ministry of Social Development and requested an explanation.
The government has been aware for many years that 98% of Work and income clients have little or no money left for food and other essential items and services once the other commitments are paid for. It created Temporary Additional Support (T.A.S.) then instructed WINZ staff to use 'discretion”. Which simply means 'find a way whereby you can deny the poor, sick, and disabled new Zealanders assistance'. (Those in the corridors of power have a cute term for poor people, they are called “Low Income” persons).
The instructions about discretion are found in the 'Minister of Social Service's Directive. Legislation states that a person's “particular financial circumstances and commitments” should be taken into consideration when granting allowances and benefits.
T.A.S. is about assisting those who have a deficit or shortfall to meet their weekly food bill and other essential commitments, like repairs and maintenance (for home owners), vehicle registration, warrant of fitness, petrol, vehicle repairs, etc from their Disposable Income.
If your disposable income is below the minimum Standard Costs, go to your GP and request, in writing, that he write a letter to the Ministry of Social Development or WINZ to the effect that you are unable to purchase adequate food, clothing, toiletries, etc on the disposable amount of xxxxx (whatever your disposable income is).

The Lie - “Though your disability and other costs have remained the same or increased you cannot continue to receive assistance.....you have had three reviews....that is all we can do”. Ministry policy is: “Where the client may not be able to improve their financial circumstances. In these cases a client may still qualify for Temporary Additional Support.” Special Benefit and Temporary Additional Support are, to all intents and purposes, the same benefit.
